(a) Every person who moves or causes to be moved, without authorization, any locomotive, is guilty of a punishable by imprisonment in the county jail not exceeding one year.
(b) Every person who moves or causes to be moved, without authorization, any locomotive, when the moving creates a substantial likelihood of causing personal injury or death to another, is guilty of a public offense punishable by imprisonment in a county jail not exceeding one year or by imprisonment pursuant to subdivision (h) of Section 1170.
