Whoever in the nighttime or daytime breaks and enters a building, ship, vessel or vehicle with intent to commit a shall be punished by a fine of not more than two hundred dollars or by imprisonment for not more than six months, or both.

Breaking and entering a building, ship, vessel or vehicle, day or night, with intent to commit a misdemeanor is punishable by up to 6 months of imprisonment, a $200 fine, or both.
